Federal Judge Orders Freedom of Abrego Garcia from ICE Detention

A court has ruled the immediate release of Kilmar Abrego Garcia from immigration custody, concluding his continued detainment lacks legal authority.

"Since Abrego Garcia's return from wrongful imprisonment in El Salvador, he has been re-detained, again without legal justification," the judge stated in her order.

The case stems from a erroneous deportation to El Salvador earlier this year, which the government later acknowledged was an error. Following his repatriation to the United States to answer alien smuggling charges, he was detained in immigration detention.

In her decision, the court pointed out that the government does not have a current removal order, which prevents them from removing Mr. Abrego Garcia "for now."
